Mojarib Platform Terms of Service

The Mojarib Platform is owned and operated by Luma Information Technology Est., a company registered in the Kingdom of Saudi Arabia under Commercial Registration No. 1010841501.

These Terms of Service govern the use of the Mojarib platform and its related digital services. By using the platform or creating an account, you agree to comply with these terms.

1. Definitions

For the purposes of these Terms:

Platform
Refers to the Mojarib platform and all related digital services.

Customer
Any individual or entity using the platform to create surveys, manage customer reviews, or collect customer experience data.

User
Any person accessing or using the platform.

Data
Any information submitted, collected, or processed through the platform.

Personal Data
Any information relating to an identifiable natural person.

2. Platform Usage

The Mojarib platform provides tools that help businesses to:

  • create surveys

  • collect customer feedback

  • manage customer reviews

  • analyze customer experience data

Users agree to use the platform lawfully and in compliance with the laws and regulations applicable in the Kingdom of Saudi Arabia.

3. User Accounts

Some platform services may require creating an account.

Users are responsible for:

  • maintaining the confidentiality of login credentials

  • all activities conducted through their account

  • keeping account information accurate and up to date

Mojarib reserves the right to suspend or terminate accounts that violate these terms.

4. Survey Content

Customers are solely responsible for:

  • the content of surveys

  • the questions presented to respondents

  • the data collected from respondents

Customers must ensure that surveys comply with applicable laws and do not violate the privacy rights of individuals.

5. Compliance with Laws

Users must comply with all applicable laws and regulations in Saudi Arabia, including:

  • e-commerce regulations

  • consumer protection laws

  • Saudi Personal Data Protection Law

6. Intellectual Property

All intellectual property rights related to the platform, including:

  • software

  • design

  • trademarks

  • platform content

belong to Mojarib or its licensors.

Users may not reproduce, distribute, or reuse any part of the platform without prior written permission.

7. Data Security

Mojarib implements appropriate technical and organizational measures to protect data against:

  • unauthorized access

  • misuse

  • loss, alteration, or disclosure

8. Service Providers

Mojarib may rely on third-party service providers to operate the platform, such as:

  • hosting providers

  • cloud infrastructure services

  • analytics services

These providers are carefully selected to maintain appropriate levels of data protection.

9. Service Suspension

Mojarib may suspend or terminate access to the platform if a user:

  • violates these terms

  • uses the platform unlawfully

14. Data Processing Agreement (DPA)

This section applies to personal data processed through the Mojarib platform.

14.1 Roles of the Parties

When using the platform to collect data through surveys:

  • The Customer acts as the Data Controller

  • Mojarib acts as the Data Processor

14.2 Scope of Processing

Mojarib processes personal data solely for the purposes of:

  • operating the platform

  • enabling customers to create surveys

  • collecting and analyzing survey responses

  • managing customer feedback and reviews

Mojarib does not use survey respondent data for its own commercial purposes.

14.3 Processing Instructions

Personal data is processed only according to:

  • the customer’s instructions

  • survey configurations defined by the customer

  • platform operational requirements

14.4 Customer Obligations

Customers are responsible for:

  • complying with applicable data protection laws

  • informing respondents about how their data will be used

  • obtaining necessary consent when collecting personal data

  • avoiding the collection of sensitive data unless permitted by law

14.5 Data Security

Mojarib implements appropriate technical and organizational safeguards to protect personal data processed through the platform.

14.6 Subprocessors

Mojarib may rely on trusted service providers (subprocessors) for infrastructure and hosting services.

14.7 International Data Transfers

Personal data may be processed outside Saudi Arabia through service providers in compliance with applicable regulations.

14.8 Data Subject Rights

Customers remain responsible for responding to requests from individuals regarding:

  • access to their personal data

  • correction of inaccurate data

  • deletion of personal data

Mojarib will reasonably assist customers in fulfilling these requests where technically feasible.

14.9 Data Deletion

Upon termination of the service, customers may request deletion or export of their data where technically feasible.
